Terms of sale

These terms of sale govern the purchase of the Gender Reveal service offered by NOGS, a SAS with share capital of 1 000 €, 436 chemin de l'Écluse, 06580 Pégomas, France, RCS Grasse 943 171 967, VAT FR14943171967 ("we"). Contact: bonjour@gender-reveal.app. By paying, you accept them.

1. The service

Gender Reveal is a digital service bought once: a personalised voting page hosted at your own address (gender-reveal.app/e/your-address), where your guests vote girl or boy, suggest first names and leave messages, with a live balloon duel. The purchase includes the voting page for one event, the QR code posters to print, the link to share, the book of entries with its export, the management space that lets you change everything including during the party, and hosting for all of it for 12 months from the purchase. The service is intended for personal, non-commercial use.

2. Price and payment

The price is €9.99$9.99 including VAT, paid once. No subscription, no renewal, no hidden paid options. Payment is handled by Stripe (bank card, Apple Pay, Google Pay and the other methods shown). Stripe sends you the payment receipt. The page goes live immediately after payment and your access link is sent to you by email.

3. Right of withdrawal

In accordance with the French Consumer Code, you have 14 days from the purchase to withdraw, without having to give a reason. Simply write to us at bonjour@gender-reveal.app from the address used for the purchase. We refund you in full, within 14 days at the latest, to the payment method used.

4. Party day guarantee

If, on the day of your event, the service is unavailable for a cause attributable to us, we refund you in full, even beyond the withdrawal period. Write to us from the address used for the purchase, stating the date of the event.

5. Your content and your guests' content

You remain the owner of the content you publish (first names, photo) and your guests remain the owners of theirs (messages, guesses). You grant us the right to host and display it, solely in order to provide the service. You warrant that you hold the rights to the photo used and you undertake, as do your guests, not to publish any unlawful or abusive content or content infringing the rights of others. Your space lets you delete any vote or message individually. In the event of manifest abuse, we may suspend an event or an account, after notification and reversibly, while we look into the situation.

6. Your link and your codes

The address of your event and your access link to the management space stand as authorisation: anyone holding them can respectively vote or administer the event. Keep your management link private. We cannot be held liable for a link shared by you or by your guests.

7. Availability and liability

We do everything we can to keep the service continuously available, without being able to guarantee it absolutely (maintenance, network incidents, force majeure). Our total liability under the service is limited to the price actually paid, save in the case of gross negligence or personal injury, and without prejudice to the party day guarantee above and to your statutory rights, in particular the legal guarantee of conformity for digital content and services (articles L224-25-12 et seq. of the French Consumer Code).

8. End of the service

At the end of the 12 months of hosting, the event page and its content are deleted. Remember to export your keepsake book from your space before that date; we remind you by email before deletion.

9. Consumer mediation

If a dispute with our customer service is not resolved, you may use a consumer mediator free of charge. Our mediator's details are provided on request at bonjour@gender-reveal.app and will be published on this page.

10. Governing law

These terms of sale are governed by French law. If you live in another country, you keep the benefit of the mandatory consumer protection provisions of your country of residence. In the event of a translation of these terms, the French version prevails. Any dispute falls to the competent French courts, or to those of your place of residence if you are a consumer.
